1. Agreement to Terms

These Terms & Conditions ("Terms") govern your access to and use of Tally, a personal nutrition and weight-tracking service operated by Bright Worldwide, LLC, an Illinois limited liability company ("Bright Worldwide", "we", "us", or "our"). By creating an account or otherwise using Tally, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Description of Service

Tally allows users to log food in plain English, track macronutrient intake, log body weight, and optionally connect third-party fitness and health devices (currently Withings and Strava). Nutritional estimates are generated by an AI model and are provided for informational purposes only. They are not a substitute for professional medical or dietary advice.

3. Eligibility

You must be at least 13 years old to use Tally. By using the service you represent that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent.

4. Accounts

Access to Tally is granted via a passwordless magic-link sent to your email address. You are responsible for keeping your email account secure and for all activity that occurs under your Tally account. Notify us immediately at support@bright.io if you suspect unauthorized access.

5. Acceptable Use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to reverse-engineer, decompile, or extract the source code of Tally.
  • Use automated scripts or bots to access or scrape the service.
  • Upload or transmit malicious code, viruses, or other harmful material.
  • Interfere with or disrupt the integrity or performance of the service.

6. Third-Party Integrations

Tally integrates with Withings and Strava via OAuth. When you connect a third-party account you are also subject to that provider's terms of service and privacy policy. Bright Worldwide is not responsible for the availability, accuracy, or conduct of any third-party service.

7. Intellectual Property

All content, design, code, and trademarks associated with Tally are the property of Bright Worldwide, LLC or its licensors and are protected by applicable intellectual property laws. You retain ownership of any personal data you submit (food logs, weight entries, etc.), and grant us a limited license to store and display it to you as part of the service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. BRIGHT WORLDWIDE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. NUTRITIONAL DATA PROVIDED BY THE SERVICE IS AN ESTIMATE AND MAY NOT BE ACCURATE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BRIGHT WORLDWIDE, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED FIFTY U.S. DOLLARS ($50.00).

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to personal jurisdiction in those courts.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Continued use of the service after any change constitutes your acceptance of the revised Terms.
